Fathers' Rights & Orders of Protection

Orders of protection are court-issued documents designed to protect an individual from unacceptable, dangerous behavior, such as threats, harassment, violence, stalking, and abuse.  No one should have to fear for their lives and safety. An order of protection gives people the peace of mind and protection they need to carry on their daily routine without fearing for their well-being.

If you feel your safety or well-being is in danger, it is important to obtain an order of protection as soon as possible. At Wisselman, Harounian & Associates, P.C., we understand the sense of urgency our clients feel when trying to acquire an order of protection. As experienced family law attorneys, we can help you take the necessary steps to obtain your order of protection as quickly and efficiently as possible. Our goal is to represent fathers in these situations by assisting them in seeking orders of protection to guard themselves and their children in these dangerous situations. For help with your case, contact a Long Island fathers' rights lawyer at our law offices today.

Long Island Orders of Protection

Legally speaking, the person who files for an order of protection is referred to as the "petitioner," and the person to whom the order of protection is taken out against is referred to as the "respondent." There are two types of orders of protection in New York:

Stay Away Order
A "stay away" order prohibits the respondent from entering the vicinity of the petitioner.  If the respondent enters the vicinity of the petitioner's home, workplace, or family, he or she can be charged with violating the terms of the "stay away" order.

Refrain-From Order
Under the terms of a "refrain-from" order, the respondent is prohibited from threatening, abusing, menacing, or harassing the petitioner. Failure to refrain from this type of behavior will result in legal penalties.

Although men are rarely identified as being victims of abuse or violence, this may be a real issue for you or your children. If you are the victim of domestic violence or abuse, you do not need to fear for your safety and well-being any longer. We are highly experienced in this area of family law, as we have successfully helped hundreds of clients obtain orders of protection throughout our careers. We can help you prove to the judge that your need for the order of protection is valid. In addition, if an order of protection has expired, we can help you take the appropriate steps to have it reinstated or file for a new one. Furthermore, if you feel you have been unjustly served a restraining order, we can investigate the situation and challenge any accusations in court.
