Orders of Protection
Orders of protection are court-issued documents designed to protect an individual from unacceptable, dangerous behavior, such as threats, harassment, violence, stalking, and abuse. No one should have to fear for their lives and safety. An order of protection gives people the peace of mind and protection they need to carry on their daily routine without fearing for their well-being.

Orders of Protection in New York
Legally speaking, the person who files for an order of protection is referred to as the “petitioner,” and the person to whom the order of protection is taken out against is referred to as the “respondent.” There are two types of orders of protection in New York:
Stay Away Order
A “stay away” order prohibits the respondent from entering the vicinity of the petitioner. If the respondent enters the vicinity of the petitioner’s home, workplace, or family, he or she can be charged with violating the terms of the “stay away” order.
Refrain-From Order
Under the terms of a “refrain-from” order, the respondent is prohibited from threatening, abusing, menacing, or harassing the petitioner. Failure to refrain from this type of behavior will result in legal penalties.
