- The spouses were married in New York state
- The spouses resided in New York as husband and wife at the time of filing for divorce
- Grounds for the divorce took place in New York state
Acceptable grounds for divorce in New York include the following:
- Abandonment for a period of one year or longer
- Adultery
- One or both spouses have been imprisoned for three years of longer
- Cruel and inhumane treatment
- The couple has lived separately for a period of one year or longer under a court-approved separation agreement
- The couple has lived separately for a period of one year or longer under a court-approved judgment of separation
