• The spouses were married in New York state
• The spouses resided in New York as husband and wife at the time of filing for divorce
• Grounds for the divorce took place in New York state

Acceptable grounds for divorce in New York include the following:

• Abandonment for a period of one year or longer
• Adultery
• One or both spouses have been imprisoned for three years of longer
• Cruel and inhumane treatment
• The couple has lived separately for a period of one year or longer under a court-approved separation agreement
• The couple has lived separately for a period of one year or longer under a court-approved judgment of separation
